These Terms of Service (“Terms”) govern your access to and use of Koze (the “App” or the “Service”). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and by any policies or notices incorporated by reference. If you do not agree, you must not use the App.
If you are using the App on behalf of an organization or another person, you represent that you have authority to accept these Terms on their behalf. Your continued use of the App after any update to these Terms constitutes acceptance of the revised Terms.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the App solely for your own non-commercial purposes. No ownership rights are transferred to you by this license.
You may use the App only in the manner intended by its features and these Terms. Any rights not expressly granted are reserved by us and our licensors.
The App is provided on an “as available” basis. We do not guarantee that the Service will be uninterrupted, timely, secure, error-free, or free from defects, delays, or technical issues.
We may change, suspend, limit, or discontinue any part of the Service at any time, with or without notice, including features, content, availability, or support. We are not responsible for any resulting loss or inconvenience to the extent permitted by law.
You must be at least 17 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.
If local law requires a higher age or parental consent for your use of the App, you are responsible for meeting those requirements before using the Service.
To the maximum extent permitted by law, Koze and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities.
This limitation applies whether the claim arises in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
The App, including its software, design, interfaces, logos, trademarks, text, and all related materials, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license granted in these Terms, no right, title, or interest in the App is transferred to you.
You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works from the App except where such restrictions are prohibited by law.
You agree not to use the App in any unlawful, fraudulent, abusive, harmful, or otherwise improper manner. Prohibited conduct includes, without limitation: attempting to interfere with the operation of the App; probing, scanning, or testing the vulnerability of the Service; using bots, scripts, scrapers, or automated tools; bypassing access controls or usage limits; and introducing malware or other harmful code.
You may not reverse engineer, disassemble, or otherwise attempt to discover the source code, underlying models, prompts, systems, or architecture of the App except to the extent permitted by applicable law. You also may not use the App to generate, upload, or distribute content that is illegal, defamatory, harassing, hateful, sexually exploitative, infringing, or otherwise harmful.
You are solely responsible for the photos, text, and any other materials you upload, submit, or share through the App, as well as for your use of any generated output. You must ensure that you have all necessary rights, permissions, and consents to provide such content to the App and to allow us to process it as described in these Terms and our privacy practices.
You are responsible for reviewing generated results before using or sharing them. You acknowledge that AI-generated output may not be accurate, appropriate, or suitable for every context, and you use it at your own discretion.
The App may offer consumable virtual currency, including coins, through Apple’s in-app purchase system. Coins are used to access or repeat certain features and are consumed when used. They have no real-world monetary value, do not constitute property, and may not be sold, transferred, or exchanged outside the App.
All purchases are final to the maximum extent permitted by law, and coins are generally non-refundable once delivered or used. We may adjust pricing, usage requirements, or product availability at any time, subject to applicable law and Apple’s rules. Any purchase is also subject to Apple’s terms and payment processing policies.
All results generated by the App are automated and created for informational, expressive, or entertainment purposes only. They are not professional advice, including but not limited to legal, medical, psychological, or financial advice.
We do not guarantee that generated content will be correct, complete, original, appropriate, emotionally accurate, or free from error. Any reliance on generated output is at your own risk, and you are responsible for evaluating whether it is suitable for your intended use.
We may suspend, limit, or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms, created risk or liability for us or others, or used the Service in an improper manner. We may also take action to protect the integrity, security, or operation of the App.
You may stop using the App at any time. Termination does not relieve you of obligations incurred before termination, including any payment obligations or restrictions that by their nature should survive.
Koze is a mobile image-to-text emotion expression tool. It allows users to upload a photo, have the image analyzed by AI to identify the scene’s atmosphere, and receive three distinct English-language writing suggestions in different styles. The service is designed to help users quickly turn a visual moment into shareable, reflective, or expressive text.
The App may present a brief scene summary based on visual elements such as location, time, mood, subjects, actions, colors, and overall atmosphere. Based on that summary, the App generates three separate drafts with different tones, such as poetic, straightforward, and humorous. Users may copy individual drafts, keep local history on their device, regenerate results by spending coins, delete saved records, and optionally create a shareable card combining image and text.
Koze is intended for personal expression and lightweight content creation, not as a chat platform or social network. The current version is limited to English output and may include a simple free-trial allocation for new users, after which access to generation features may require consumable coin purchases through Apple in-app purchases. The App may also request camera, photo library, and photo-saving permissions only when needed to support the relevant features.
We may revise these Terms from time to time. When we do, we may update the effective date or provide notice through the App or by other reasonable means.
Your continued use of the App after changes become effective means you accept the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.
You retain ownership of the photos and other content you upload to the App. We do not claim ownership of your user content. However, by submitting content to the App, you grant us a limited, worldwide, non-exclusive, royalty-free, temporary license to host, process, analyze, transmit, and display that content solely as needed to operate the Service and provide the features you request.
This license ends when the content is deleted or no longer needed for the Service, except to the extent retention is required for legal, security, accounting, fraud prevention, or operational purposes. You represent that your content does not violate the rights of others and that you have the authority to provide it to us for processing.
To the maximum extent permitted by law, the App and all related services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory.
We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will meet your expectations or that any content or result will be accurate, reliable, or suitable for your needs.
You agree to defend, indemnify, and hold harmless Koze and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the App, your violation of these Terms, your infringement or violation of any third-party rights, or your submission or sharing of content through the Service.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.
These Terms and any dispute arising out of or relating to them will be governed by and interpreted in accordance with the applicable laws of the jurisdiction where the Service is offered, without regard to conflict-of-law principles, except where such principles are required by mandatory law.
Where local consumer protection or mandatory legal rights apply, nothing in these Terms will limit those rights to the extent such limitation is not permitted by law.
